Pestering a son-in-law to abandon his parents and start living with his in-laws as 'ghar jamai' amounts to cruelty, the Delhi High Court has held while granting a divorce decree in favour of a man. A bench of Justices Suresh Kumar Kait and Neena Bansal Krishna set aside an order of a family court, which had dismissed the husband's divorce petition, and granted divorce to the couple on the ground of cruelty and desertion by the wife. The man said in his plea that he got married in May 2001 and, within a few months of the marriage, his wife left her matrimonial home and went back to her parents in Delhi during pregnancy. He said he made sincere efforts to convince her to return to the matrimonial home but she refused, while she and her family members insisted that he shift from Gujarat to Delhi and stay in their house as 'ghar jamai' (resident son-in-law), a proposal to which he did not agree as he had aged parents to take care of. The Supreme Court Wednesday said there is "intrinsic evidence" that Article 370 has a "self-limiting character" and it seems to have worked itself out after the term of the Jammu and Kashmir Constituent Assembly ended in 1957. "Really speaking, though the Constitution of Jammu and Kashmir framed its relationship with Union of India, unless that relationship was embodied in the Indian Constitution, how will it bind the dominion of India or Parliament for successive years after 1957," the bench, also comprising Justices Sanjay Kishan Kaul, Sanjiv Khanna, BR Gavai and Surya Kant, said. ISRO Chairman S Somanath on Wednesday toasted the success of the Chandrayaan-3 mission, crediting it to the “pain and agony” of all the scientists who persevered on it and expressed confidence that the space agency would similarly land a spacecraft on Mars in the coming years. The journey to the Moon is tough and soft-landing is difficult for any nation to achieve today even with the advancement of technology, he said, pointing out that India achieved it in just two missions. Chandrayaan-2, the first mission with the objective of soft landing on the Moon had a narrow miss, while the Chandrayaan-3 mission was perfectly executed. Chandrayaan-1's objective was only to place an unmanned spacecraft in an orbit around the Moon. "It (succes

The Supreme Court Tuesday termed as "unacceptable" the submission that Article 370 of the Constitution ceased to operate once the term of the constituent assembly of Jammu and Kashmir ended in 1957 after drafting the state's Constitution. The remark by a five-judge bench headed by Chief Justice DY Chandrachud came when senior advocate Dinesh Dwivedi, appearing for intervenor Prem Shankar Jha, argued that nothing of Article 370, which accorded special status to the erstwhile state, survived once the Constitution of J-K was enacted on January 26, 1957 and the term of the state's constituent assembly ended. Jha, who has challenged the August 5, 2019 decision of the Centre to abrogate Article 370, raised the legal question about whether Article 370 ceased to operate or exist after the enactment of the Constitution of J&K and the dissolution of the constituent assembly. This led the bench to raise queries on the legality of the submissions. The bench, also comprisi

In a written reply, Law Minister Arjun Ram Meghwal said the Election Commission has informed that some representations have been received regarding the reintroduction of the ballot system. The EC, he said, has been conducting elections using EVMs since 1982. The use of Electronic Voting Machine and Voter Verifiable Paper Audit Trail machines is legally sanctioned by Parliament in the form of clear provisions in the Representation of the People Act 1951. He said the law on the use of EVMs has also been subjected to judicial reviews in a number of cases up to the level of the Supreme Court. "There is no proposal to go back to ballot system," he said.
